Fixed Price Software Development Agreement

This is the best Online Contract Template when you want an agreement that covers the following things:

• The delivery of a output-based service with a specified deliverable, including a software program, report or other document.
• This agreement enables you to provide services for the configuration or customisation of a third party software product, where that third party software product is licensed by the owner of the software product directly to the customer, and the customer provides that software product to you as a customer-supplied item.  (Additional clauses will need to be added if the ICT supplier is supplying its own software or third party software, and that software is being configured or customised for the customer’s needs.)

The Online Contract Template does not deal with the provision of ongoing support services following the warranty period.  Given that support services for customised software are not a “standard product” it is common for any support services to be provided on a customised support contract, usually based on a time and materials consulting services agreement.
