HARDWARE SALE AND MAINTENANCE AGREEMENTS

In this section we discuss the issues that are relevant to the sale of hardware products and their maintenance. Whilst the primary focus is on those organisations that manufacture and maintain their own hardware, we have also provided advice for those people who are distributors or resellers of equipment that is owned by a third party original equipment manufacturer (OEM). Whilst many of the considerations for reseller agents and distributors are the same, distributors have the additional consideration of ensuring that the agreement with the OEM can be back-to-backed with the ICT supplier’s agreement with its customers.
